@Whitehouse Eddy Lepp is now in jail. Show us the change...
From @CharlesCLynch Today Eddy Lepp called me at about 10:30am and said they were getting ready to pass through Pismo Beach. I hopped into my car and caught up with them on the freeway and followed them to Lompoc. There was a traffic jam on the way down and I figured that in Eddy's mind there was probably no big rush as he was on his way to serve a 10 year mandatory sentence in Federal Prison for growing Marijuana. Eddy had a farm where he was growing over 25,000 plants or more when he was raided by the DEA in 2004. The feds prosecuted Eddy in Federal Court and he was convicted of growing more that 1000 marijuana plants which has a 10 year mandatory minimum sentence. Eddy tried claiming medical and religious protections but the arguments were not allowed in Federal Court. In the picture above, once we got to Lompoc we pulled over for a photo opp under the signs pointing to the Prison. It was a sad moment as Eddy his wife and followers realized he was only minutes from a long sentence in Federal Prison.
@Whitehouse please inform Sheriff Pat Hedges that he works for the state of California, and not the DEA.
"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." The Tenth Amendment
Then : @Whitehouse The policy is to go after those people who violate both federal and state law, to the extent that people do that and try to use medical marijuana laws as a shield for activity that is not designed to comport with what the intention was of the state law. Those are the organizations, the people, that we will target. And that is consistent with what the president said during the campaign.
Now : @CharlesCLynch Was sentenced to one year and one day in Federal prison. The judge let me stay out of jail pending appeal. He believed there was strong evidence that an appeal would be successful. Will update site in next day or so. Still in LA with friends.
How is that consistent with what the president said during the campaign? @NeonSurfer
By all accounts (including his own), President Barack Obama had a great time during his recent trip to France. And elite opinion at places ranging from Newsweek to The Economist to the Brookings Institution is urging Obama to make America more like France and Europe.
Should the United States become the next France, a land of high taxes, regulation, and government spending? And, not uncoincidentally, comparatively low economic growth?
In "Obama's French Toast: Just Say Non," Sorbonne-trained economist Veronique de Rugy of the Mercatus Center at George Mason University argues that embracing the French way would be nothing less than a train wreck, leaving Americans with fewer jobs and less disposable income.

The dispensary opened on April 1 2006 with the blessing of the city and even joined the Chamber of Commerce. In July 2006 the dispensary was granted a Conditional Use Permit from the City of Morro Bay to include a Medical Cannabis Nursery at the dispensary.
The Dispensary operated for almost one year without any major problems or complaints to the owner. On March 29, 2007 the Local Sheriff and DEA agents raided the Dispensary and Home of Charles Lynch. Lynch was not arrested at the time and reopened the dispensary on April 7 2007 with the blessing of the City of Morro Bay. A week after reopening the dispensary the DEA called the Landlord and threatened him with Forfeiture of his property unless he evicted the Dispensary from the building. On May 16, 2007 the Dispensary closed permanently.
On July 17, 2007 Lynch was arrested at his home and charged with Federal Marijuana Distribution. Lynch pleaded not guilty and went on trial July 22, 2008 in Los Angeles. Lynch was not allowed to discuss state law or mention 'medical marijuana' during the trial. Also large amounts of evidence including Lynch's compliance with State and Local laws could not be considered as factual by the jury. Before opening the dispensary Lynch called the DEA and asked about thier policy regarding medical marijuana dispensaries. The DEA told Lynch it was up to the Cities and Counties to decide how to handle the matter. This was Lynch's only defense in Federal Court and is called entrapment by estopell when a government agent says something is ok when in fact it might not be. Click here for more information.
On August 5, 2008 Lynch was convicted in Federal Court for operating the Central Coast Compassionate Caregivers. On January 6, 2009 Lynch appeared before Judge Wu to request a new trial on the grounds that he was not allowed to get his defense before the jury and other new evidence. The request was denied. Charles has been out on a $400,000 bail posted by his loving and trusting family and was under house arrest for over nine months.
During March 2009 United States Policy regarding Medical Marijuana changed in favor of states as long as the dispensary complied with state law. Lynch's dispensary complied with all state and local laws during the time it was open. Click here to read the San Francisco Chronicles report of the new policy. On Friday March 13, 2009 John Stossel and ABC News 2020 aired the story of Lynch on National Television. On Sunday March 15 Al Roker did a documentary entitled Marijuana Inc. Al Roker reporting and focused in on the case of Charles C. Lynch. On Friday March 27, 2009 Lynch appeared on Larry King Live with his Federal Public Defenders.
Sentencing which was scheduled for March 23, 2009 was postponed because the judge requested information from the Government regarding the New Policy regarding medical marijuana dispensaries. Despite the recent policy changes Charles C. Lynch will be sentenced on April 30, 2009 at the Federal Court House in Los Angeles. Supporters who wish to write a letter of support regarding sentencing should use the Letter salutation "Dear Judge Wu" and then send the letter to:

Amongst liberals, libertarians, and even some conservatives, there has considerable "hope" that a Barack Obama presidency would radically transform Bush administration policies regarding the "war on terror." And, on certain issues, the new administration has delivered a measured amount of "change." But were Obama's executive orders banning torture and closing down the prison at Guantanamo Bay, signed on his first two days in office, just a head fake? Were they designed to placate a certain segment of his base, while actually continuingor even expandingmany of Bush administration terrorism policies?
Does the financial crisis make clear that capitalism, the free market and the classical liberal ideology are failing? Of course not, whatever social democrat ideological veterans might proclaim. Socialism and its derivatives have been morally discredited since the fall of the Berlin wall and there is no chance for them of getting back. People get a grasp that there is something wrong with the way the system works for now, but not with the system itself...

And the world looks just the same
And history ain't changed
'Cause the banners, they all flown in the last war
I'll tip my hat to the new constitution
Take a bow for the new revolution
Smile and grin at the change all around me
Pick up my guitar and play
Just like yesterday
No, no!
I'll move myself and my family aside
If we happen to be left half alive
I'll get all my papers and smile at the sky
For I know that the hypnotized never lie
Do ya?
YAAAAAAAAAAAAAAAAAH!
There's nothing in the street
Looks any different to me
And the slogans are replaced, by-the-bye
And the parting on the left
Is now the parting on the right
And the beards have all grown longer overnight
I'll tip my hat to the new constitution
Take a bow for the new revolution
Smile and grin at the change all around me
Pick up my guitar and play
Just like yesterday
Then I'll get on my knees and pray
We don't get fooled again
Don't get fooled again
No, no!
Thank you, President Obama, for keeping your campaign pledge to end raids on medical marijuana dispensaries that are legal under state laws in California and elsewhere. Thank you for reversing an inhumane policy established by the Clinton administration and continued by the Bush administration.
Given the experience you and other elected officials have had with illegal drugs and your willingness to challenge the status quo, now is the time to reconsider decades of prohibitionist drug policies that have succeeded only in massively increasing the toll of human misery, violence, and hypocrisy. As with alcohol prohibition, the drug war intensifies and exacerbates every negative outcome it is ostensibly designed to combat.
President Obama, do the right thing and end the war on drugs.
The Revolution Will Be Televised, Or Watching Americas Berlin Wall Fall
Speaking at a press conference on Feb 25 with DEA Administrator Michele Leonhart, and reiterating a position made by the White House following DEA raids in California on February 4, U.S. Attorney General Eric Holder told reporters that ending federal raids on medical marijuana dispensaries "is now American policy." The Attorney General's comments are the latest sign of a sea change in federal policy that prohibits the use of medical cannabis in the thirteen states that have enacted such laws.
Because there's always more hate to go around, we proudly present this "lost episode" in which Tubesteak pays homage to The First Black President--MISTER BILL CLINTON!!!
Because you know what? Its none of your goddamned business. I work my ass off 10 months a year. Its that hard work that gave you all those gooey feelings of patriotism last summer. If during my brief window of down time I want to relax, enjoy myself, and partake of a substance thats a hell of a lot less bad for me than alcohol, tobacco, or, frankly, most of the prescription drugs most of you are taking, well, you can spare me the lecture.
I put myself through hell. I make my body do things nature never really intended us to endure. All world-class athletes do. We do it because you love to watch us push ourselves as far as we can possibly go. Some of us get hurt. Sometimes permanently. Youre watching the Super Bowl tonight. Youre watching 300 pound men smash each while running at full speed, in full pads. You know what the average life expectancy of an NFL player is? Fifty-five. Thats about 20 years shorter than your average non-NFL player. Yet you watch. And cheer. And you jump up spill your beer when a linebacker lays out a wide receiver on a crossing route across the middle. The harder he gets hit, the louder and more enthusiastically you scream.
Yet you all get bent out of shape when Ricky Williams, or I, or Josh Howard smoke a little dope to relax. Why? Because the idiots youve elected to make your laws have, without a shred of evidence, beat it into your head that smoking marijuana is something akin to drinking antifreeze, and done only by dirty hippies and sex offenders.
Youll have to pardon my cynicism. But I call bullshit. You dont give a damn about my health. You just get a voyeuristic thrill from watching an elite athlete fall from graceall the better if you get to exercise a little moral righteousness in the process. And its hypocritical righteousness at that, given that 40 percent of you have tried pot at least once in your lives.
Heres a crazy thought: If I can smoke a little dope and go on to win 14 Olympic gold medals, maybe pot smokers arent doomed to lives of couch surfing and video games, as our moronic government would have us believe. In fact, the list of successful pot smokers includes not just world class athletes like me, Howard, Williams, and others, it includes Nobel Prize winners, Pulitzer Prize winners, the last three U.S. presidents, several Supreme Court justices, and luminaries and success stories from all sectors of business and the arts, sciences, and humanities.
Tell you what. Ill make you a deal. Ill apologize for smoking pot when every politician who ever did drugs and then voted to uphold or strengthen the drug laws marches his ass off to the nearest federal prison to serve out the sentence he wants to impose on everyone else for committing the same crimes he committed. Ill apologize when the sons, daughters, and nephews of powerful politicians who get caught possessing or dealing drugs in the frat house or prep school get the same treatment as the no-name, probably black kid caught on the corner or the front stoop doing the same thing.
Until then, I for one will have none of it. I smoked pot. I liked it. Ill probably do it again. I refuse to apologize for it, because by apologizing I help perpetuate this stupid lie, this idea that what someone puts into his own body on his own time is any of the governments damned business. Or any of yours. Im not going to bend over and allow myself to be propaganda for this wasteful, ridiculous, immoral war.
Go ahead and tear me down if you like. But lets see you rationalize in your next lame ONDCP commercial how the greatest motherfucking swimmer the world has ever seen...is also a proud pot smoker.
I have a dream that my four little children will one day live in a nation where they will not be judged by the color of their skin but by the content of their character.
The TCA is asking the Bush Administration to overturn the 8-2 decision of the California Coastal Commission to stop this toll road and save the park and beach. To lobby the Bush Administration and quell a rebellion in Congress, TCA will spend $56,500 a month on three lobbying firms. Director Norby has sticker shock after calculating they are paying lobbyists up to $700 an hour.
Notice all the pro toll road spam we are seeing on the internets?

As expected today, the Federal Register printed the notice for the TCA's appeal of the CA Coastal Commission's decision. The CCC's jurisdiction is provided by the National Oceanic and Atmospheric Administration (NOAA), which resides in the US Dep't of Commerce. This means that the ultimate decision on whether to honor the CCC's decision or over-ride it lies with the Secretary of Commerce.
Today's announcement tells us that NOAA will be accepting comments for 30 days starting on April 28. This will be your opportunity to let the federal government know what has been made clear here in California: No Toll Roads through San Onofre State Beach!!
Starting on the 28th we'll provide an electronic action alert to make it easy for you to send in your comments. We are also requesting that NOAA hold a public hearing on this issue to give the public a chance to voice your opinions.
NOAA pulled together a really nice FAQ on the process. Of particular importance is this:
"What does the Secretary consider on appeal from a states objection?
The Secretary may override a states objection if the proposed activity is either:
Consistent with the objectives of the CZMA. Projects consistent with the objectives of the CZMA are those where: a) the project furthers the national interest in the CZMA objectives in a significant or substantial manner; b) this national interest outweighs any adverse coastal effects (both separately and cumulatively); and c) there is no reasonable alternative available that would allow the activity to proceed consistent with the state program; or
Necessary in the interest of national security. " .

Can be both a political strategy or moral philosophy that rejects the use of violence in efforts to attain social or political change. As an alternative to both passive acceptance and armed struggle, nonviolence proclaims other means of popular struggle such as civil disobedience, nonviolent resistance or the power of non co-operation combined with persuasion. While frequently used as a synonym for pacifism, since the mid 20th century the term nonviolence or nonviolent resistance has come to embody a diversity of techniques for social change without the use of force, as well as the underlying political and philosophical rationale for the use of these techniques. Nonviolent resistance is different from pacifism because it is a direct attack on the oppressor's will and sense of right and wrong... .
90% of the negative marijuana information out there is government disinformation propaganda and doesn't fit the true data. Also nations who have backed off of drug war especially concerning marijuana have had much less related drug problems than the USA. It's a long process of looking at all the data and POVs something most politicians wouldn't dream of when it comes to this controversial topic. Two former U.S. Border Patrol agents -- Ignacio Ramos and Jose Compean -- are serving 11- and 12-year prison terms for attempting to apprehend an illegal alien drug smuggler. The smuggler, who was transporting 743 pounds of marijuana (about $1 million worth), was given full immunity to testify against our agents and is suing our government for $5 million.
Now, reports indicate that the Mexican government was instrumental in this case even being launched. Plus, our own government has been lying about key details in the case. Meanwhile, the agents sit in jail (Ramos was severely beaten by Mexican nationals in jail who shouted death to the border agent), the drug smuggler may get rich and our President has not taken action!!! .

I was arrested in Kennebunkport, Maine, in 1976 for driving under the influence of alcohol. I pled guilty, paid a fine, and had my driver's license suspended for 30 days. My Texas driving record has been "lost" and is not available.
MILITARY: I joined the Texas Air National Guard and went AWOL. I refused to take a drug test or answer any questions about my drug use. By joining the Texas Air National Guard, I was able to avoid combat duty in Vietnam.
COLLEGE: I graduated from Yale University with a low C average. I was a cheerleader.
PAST WORK EXPERIENCE: I ran for U.S. Congress and lost. I began my career in the oil business in Midland, Texas, in 1975. I bought an oil company, but couldn't find any oilin Texas. The company went bankrupt shortly after I sold all my stock. I bought the Texas Rangers baseball team in a sweetheart deal that took land using taxpayer money. With the help of my father and our right-wing friends in the oil industry (including Enron CEO Ken Lay), I was electedgovernor of Texas.
ACCOMPLISHMENTS AS GOVERNOR OF TEXAS: I changed Texas pollution laws to favor power and oil companies, making Texas the most polluted state in the Union. During my tenure, Houston replaced Los Angeles as the most smog-ridden city in America. I cut taxes and bankrupted the Texas treasury to the tune of billions in borrowed money. I set the record for the most executions by any governor in American history
With the help of my brother, the governor of Florida, my father's appointments to the Supreme Court, I became President after losing by over 500,000 votes.
ACCOMPLISHMENTS AS PRESIDENT: I am the first President in U.S. history to enter office with a criminal record. I invaded and occupied two countries at a continuing cost of over one billion dollars per week. I spent the U.S. surplus and effectively bankrupted the U.S. Treasury. I shattered the record for the largest annual deficit in U.S. history. I set an economic record for most private bankruptcies filed in any 12-month period. I set the all-time record for most foreclosures in a 12-month period. I set the all-time record for the biggest drop in the history of the U.S. stock market. In my first year in office, over 2 million Americans lost their jobs and that trend continues every month. I'm proud that the members of my cabinet are the richest of any administration in U.S. history. My "poorest millionaire," Condoleeza Rice, has a Chevron oil tanker named after her. I set the record for most campaign fund-raising trips by a U.S. President. I am the all-time U.S. and world record-holder for receiving the most corporate campaign donations. My largest lifetime campaign contributor, and one of my best friends, Kenneth Lay, presided over the largest corporate bankruptcy fraud in U.S. History, Enron. My political party used Enron private jets and corporate attorneys to assure my success with the U.S. Supreme Court during my election decision. I have protected my friends at Enron and Halliburton against investigation or prosecution. More time and money was spent investigating the Monica Lewinsky affair than has been spent investigating one of the biggest corporate rip-offs in history. I presided over the biggest energy crisis in U.S. history and refused to intervene when corruption involving the oil industry was revealed. I presided over the highest gasoline prices in U.S. history. I changed the U.S. policy to allow convicted criminals to be awarded government contracts. I appointed more convicted criminals to administration than any President in U.S. history. I created the Ministry of Homeland Security, the largest bureaucracy in the history of the United States government. I've broken more international treaties than any President in U.S. history. I am the first President in U.S. history to have the United Nations remove the U.S. from the Human Rights Commission. I withdrew the U.S. from the World Court of Law. I refused to allow inspectors access to U.S. "prisoners of war" detainees and thereby have refused to abide by the Geneva Convention. I am the first President in history to refuse United Nations election inspectors (during the 2002 U.S. election). I set the record for fewest number of press conferences of any President since the advent of television. I set the all-time record for most days on vacation in any one-year period. After taking off the entire month of August, I presided over the worst security failure in U.S. history. I garnered the most sympathy for the U.S. after the World Trade Center attacks and less than a year later made the U.S. the most hated country in the world, the largest failure of diplomacy in world history. I have set the all-time record for most people worldwide to simultaneously protest me in public venues (15 million people), shattering the record for protest against any person in the history of mankind. I am the first President in U.S. history to order an unprovoked, pre-emptive attack and the military occupation of a sovereign nation. I did so against the will of the United Nations, the majority of U.S. citizens, and the world community. I have cut health care benefits for war veterans and support a cut in duty benefits for active duty troops and their families -- in war time. In my State of the Union Address, I lied about our reasons for attacking Iraq, then blamed the lies on our British friends. I am the first President in history to have a majority of Europeans (71%) view my presidency as the biggest threat to world peace and security. I am supporting development of a nuclear "Tactical Bunker Buster," a WMD. I have so far failed to fulfill my pledge to bring Osama Bin Laden to justice. RECORDS AND REFERENCES: All records of my tenure as governor of Texas are now in my father's library sealed and unavailable for public view. All records of SEC investigations into my insider trading and my bankrupt companies are sealed in secrecy and unavailable for public view. All records or minutes from meetings that I, or my Vice-President, attended regarding public energy policy are sealed in secrecy and unavailable for public review
